Employee Compliance


In Hong Kong there are different kinds of employee protection regulations and reports to respective Government office(s). Employer needs to prepare for it when the company is employing staff.

All employers in Hong Kong are required to take out Employees Compensation Insurance to cover workers against accident or injury during the course of their employment. Employees Compensation Insurance is the minimum insurance coverage required by Hong Kong law. The cost of the insurance will depend upon the risk of the individual employment.

Mandatory Provident Fund (MPF) will affect every employer and employee in Hong Kong. Employers must establish an MPF scheme even if they provide voluntary retirement benefits. The contribution to MPF is calculated on the relevant income of the employee. Individuals who enter Hong Kong for the purposes of being employed or self-employed for a limited period or who are members of a provident, pension, retirement, or superannuation scheme in a place outside HK are exempt from MPF.

Filing of employer returns to Inland Revenue Department is compusoily required annually in April to May each year. The total salary and allowance paid & payable to employees in the fiscal year must be reported in the prescribed form. Non-compliance will be an offence.
